The Bankruptcy Process: What to Expect

The Automatic Stay Provides Immediate Relief

The moment your bankruptcy petition is filed with the court, an automatic stay goes into effect. This court order immediately stops most collection actions, including wage garnishments, lawsuits, foreclosure proceedings, and harassing creditor phone calls.

Six-Step Bankruptcy Process

Step 1: Initial Consultation

Our attorneys discuss your financial concerns and determine if bankruptcy is appropriate for your situation. We consider whether Chapter 7 or Chapter 13 is the better option and address pre-bankruptcy planning to identify any potential issues before filing.

Step 2: Financial Documentation

You gather the required financial documents and complete the bankruptcy forms. Materials can be submitted by mail, fax, email, or our after-hours drop box -- whatever is most convenient for you.

Step 3: Pre-Filing Education

A mandatory credit counseling course must be completed within 180 days before filing. We provide you with a list of approved agencies to make this step as easy as possible.

Step 4: Petition Review and Filing

Our attorneys prepare the initial petition draft. You then meet with us to review all forms, make any necessary corrections, and sign the documents before we file them electronically with the court.

Step 5: 341 Meeting of Creditors

This hearing occurs within 4 to 6 weeks after filing. A trustee handles the asset review and creditor distribution process. You must bring a state-issued photo identification to this meeting. For Chapter 13 filers, an additional Confirmation Hearing is held where the judge approves your repayment plan.

Step 6: Financial Management Course and Discharge

A post-petition financial management course must be completed before discharge. For Chapter 7 cases, discharge typically occurs approximately 90 days after filing. For Chapter 13 cases, discharge happens upon successful completion of your repayment plan.

What Documents Will You Need?

  • Six months of pay stubs or proof of income
  • Federal and state tax returns for the past two years
  • Bank and financial account statements
  • A complete list of all debts, creditors, and amounts owed
  • Documentation of property, vehicles, and other assets
