Motor vehicle theft is a serious felony in Washington State, carrying harsher penalties than general theft charges of equivalent value. Washington law defines several distinct motor vehicle-related offenses, each with different elements and severity levels. At the Law Office of Erin Bradley McAleer, we defend all types of auto theft charges in Clark County and throughout Southwest Washington.

Auto Theft Is Always a Felony

Under Washington law, theft of a motor vehicle is classified as a Class B felony regardless of the vehicle's value, carrying up to 10 years in prison and fines up to $20,000. This is more severe than a standard theft charge, making experienced legal representation essential.

Types of Motor Vehicle Offenses

Theft of a Motor Vehicle

Taking a vehicle with the intent to permanently deprive the owner of it. This is a Class B felony punishable by up to 10 years in prison and fines up to $20,000.

Possession of a Stolen Vehicle

Possessing a vehicle with knowledge that it was stolen. This is also a Class B felony with penalties of up to 10 years in prison and up to $20,000 in fines.

Taking a Motor Vehicle Without Permission -- 1st Degree

Stealing a vehicle and attempting to change, conceal, or sell it without the owner's permission. This is a Class B felony carrying up to 10 years in prison and $20,000 in fines. It is considered more serious than simple theft with potentially harsher sentencing.

Taking a Motor Vehicle Without Permission -- 2nd Degree

Taking a motor vehicle without authorization or driving a stolen vehicle unknowingly. This is a Class C felony with penalties of up to 5 years in prison and $10,000 in fines.

Making or Possessing Motor Vehicle Theft Tools

Producing or possessing tools intended for vehicle theft, such as false keys, slide hammers, or nippers. This is a gross misdemeanor punishable by up to 364 days in jail and $5,000 in fines.
